FACILITATOR CODE OF ETHICS

PSYCHEDELIC FACILITATORS HAVE A DUTY TO MAINTAIN THE HIGHEST LEVEL OF SAFETY AND ETHICAL INTEGRITY TOWARD EVERY CLIENT & THEIR FAMILY.

Up until this point, psychedelic therapy in the Western world has lived largely underground, and with that has come a lack of regulation or regulatory bodies. Unfortunately, pockets of psychedelic underground therapy have had a dark history, wherein certain practitioners misused the power dynamic and vulnerability inherent in the medicine to abuse their clients.

Through the legal framework of Oregon’s Measure 109, all Facilitator Training programs include required modules on safety, ethics and harm reduction. State-licensed facilitators are ethically and legally liable to ensure clients remain safe from harm at the facilitator’s own hands. Further, the Oregon Health Authority is the regulatory body through which any and all complaints can be made and will be investigated thoroughly.

As professional and empathetic practitioners, we want to share our Code of Ethics for all Facilitators at Fractal Soul. We also have a list of Client Expectations, which is a basic set of expected behaviors to be demonstrated by our clients in order not to violate the trust bond that is required for effective relationships and healing.

Our own Code of Ethics was created from the Oregon Code of Ethics and the MAPS Facilitator Code of Ethics. Check out the links if you’d like to read further.

#1 ALL FACILITATORS MUST CONSISTENTLY DISPLAY REQUIRED CORE COMPETENCIES FOR PSYCHEDELIC THERAPY

These six Core Competencies are:
#1 Client-Centered Care (vs Facilitator-Centered)
#2: Thorough Knowledge of Physical & Psychological Effects of Psilocybin
#3: Empathetic Abiding Presence
#4: Trust Enhancement & Trauma-Informed Training
#5: Self-Awareness, Emotional Intelligence & Ethical Integrity
#6: Spiritual Intelligence

#2 FACILITATORS MUST EMPLOY PRACTICE OF ‘DO NO HARM

All Facilitators shall strive to their utmost to do no harm, and to strive to provide maximum benefit to clients, to act in clients’ best interests at all times, and to safeguard the welfare of clients.

#3 FACILITATORS MUST ADHERE TO THEIR DUTIES OF LOYALTY, CARE AND CONFIDENTIALITY

Also known as Fiduciary duties, these are intended to protect the more vulnerable party in relationships where one party has greater expertise and/or influence. Because an intrinsic power dynamic exists in all such relationships, Facilitators must employ their fiduciary responsibility toward their clients to care for them, keep their therapy confidential, and remain loyal to the clients’ interests, putting them above their own.

Unless required by law, disclosures of client information shall be made only with a client’s written consent. Facilitators shall not disclose confidential client information when consulting with colleagues or with other clients.

Please note, Oregon Licensed Psilocybin Facilitators are not mandatory reporters, unless they also hold another license or position in which they are.

#4 FACILITATORS WILL BE SENSITIVE TO THE VULNERABILITY & SUGGESTIBILITY ASSOCIATED WITH ALTERED STATES OF CONSCIOUSNESS, AND WILL USE A NON-DIRECTIVE APPROACH TOWARD FACILITATION OF SESSIONS

Clients of psychedelic therapy may be especially open to suggestion, manipulation, or exploitation, and because the emotional or mental effects of psychedelics can persist for months, this state of vulnerability may be prolonged, which requires increased attention to safety and consent.

A non-directive approach to Facilitation is characterized by maintenance of a consistent, warm, and affirming disposition with clients, while avoiding giving clients direct advice or directly interpreting their statements or behaviors. The goal of non-directive facilitation is for clients to discover things about themselves for themselves with only minimal guidance from a facilitator. The pace and direction of facilitation are controlled by clients, while facilitators serve in a supportive role. An exception would be when safety is at stake, at which point facilitators shall become directive only in the service of safety.

Please note: Non-directive approach toward psychedelic therapy facilitation is not to be conflated with our approach toward Health Coaching, if applicable/relevant. If you are engaging in Health Coaching, we will discuss in advance with you whether you prefer more of a coaching or consulting type of approach. This would refer to your nutrition, exercise, etc.

#5 FACILITATORS SHALL USE MINIMAL SUPPORTIVE TOUCH DURING SESSIONS AND ALL TOUCH WILL BE AGREED IN WRITING WITH CLIENT BEFOREHAND

Facilitators will work with each client ahead of time to create a ‘Touch Plan’. This is a directive by the Client of what level of touch they are comfortable receiving (or believe they will be comfortable receiving). Clients can choose from:

– No Touch At All
– Touch On Hand Only
– Touch on Hand, Foot, Shoulder, and/or Top of Head, or
– Touch on Hand, Foot, Shoulder, Top of Head and Supportive Hugs When Requested (shoulder hugs provided only while standing, not laying down)

Despite client request, no further touch shall be provided by Facilitators by law. Under no circumstances shall a Facilitator touch a client between the region below their collarbone to their knees before, during or after a Psychedelic Therapy session. Under no circumstances will a Facilitator touch a client on any part of their body with any part of the Facilitator’s body other than the Facilitator’s hand.

During a session, the client has the right to change their mind regarding their touch plan to the extent they desire less touch. Facilitators shall not engage in more touch than was agreed upon in the Written Touch Plan during the session, even if requested by client. Clients have an opportunity to alter their Supportive Touch Plans between sessions as they grow more familiar with the medicine and their reactions while on it.

Finally, under no circumstances are Facilitators to engage in romantic or sexual relationships with clients outside of the therapeutic relationship. Facilitators may not engage in such relationships with clients for a period of one year following termination of services. Facilitators are also not to knowingly engage in romantic or sexual relationships with any direct member (parent, child, sibling) of a client’s family. In the event the relationship becomes known to the Facilitator, one of the relationships must be terminated (client relationship or romantic relationship) in order to avoid conflict of interest and/or potential undue influence.

#6 PRICING, SOURCING & SERVICES WILL REMAIN TRANSPARENT TO CLIENTS

Though Fractal Soul offers bundled-service, membership-style pricing for your convenience, State Law and Federal Tax Law both require us to charge for psilocybin products separately from all other wellness and facilitation services. (We are hoping this changes in 2025 with FDA approval!)

Thus, the membership fee that is paid via your online account to Fractal Soul is for all relevant coaching, consulting, facilitation and harm reduction services as well as our in-person wellness center (including rental of your private suite for Phoenix Sessions). It also incorporates all our online Membership benefits such as the Membership Community, Online Learning library, and Member-only events.

When you arrive at a Fractal Soul service center for a class or session that involves consuming psilocybin, you will purchase the actual psilocybin product separately from our sister company, Fractal Earth Medicine. The cost of the psilocybin product itself is small, and we have calculated evenly-rounded prices (ie $5, $20) to include the required 15% tax.

IT IS ALWAYS YOUR CHOICE NOT TO CONSUME PSILOCYBIN, OR TO CONSUME A LOWER DOSE THAN PLANNED.

All agreements for pricing of both for services and separate purchase of psilocybin products will be included in your Client Contract and discussed in person to ensure you fully understand prior to commitment.

If you are unable to make any in-person class or session, any refunds will follow our standard refund policy. You can see a comprehensive cancellation and refund policy in our Terms of Service. If you pay for psilocybin product at our service center and then choose not to consume it, you are entitled to a full refund of the product.

All clients have the right to inspect the information packet associated with the psilocybin product they are taking at any time. We source only from State-licensed producers with State-licensed lab testing for potency, purity, etc. We proudly support women and minority owned businesses where possible.

#7 FRACTAL SOUL WILL ADHERE TO ALL RECORD KEEPING REQUIREMENTS AND CLIENTS ARE ALLOWED TO SEE THEIR PERSONAL RECORDS AT ANY TIME

State Law requires us to keep client records for five years, which we do on a secure, cloud-based storage platform. Much of your records we’ve attempted to make online as part of your Account Settings. For information that we are not able to make part of your online account, we will provide a PDF copy to you within 3-5 business days of request. This would include your client encounter record including all dates, dosages, session length, identity and batch number of product, and outcomes of psilocybin therapy.

#8: SPECIAL CARE WILL BE TAKEN WHEN A FACILITATOR HAS BEEN IN A PRE-EXISTING (BUT NOT ROMANTIC) RELATIONSHIP WITH A CLIENT

A pre-existing relationship is one in which a Facilitator and a Client have previously known one another in a different context – colleague, friend, neighbor, acquaintance, members of the same church or hobby group, etc. Pre-existing relationships can range from barely knowing one another to very close or intimate.

It is a known risk factor that the conflation of pre-existing relationships with the provision of psilocybin services can be problematic and may impair either the facilitator’s or the client’s objectivity or effectiveness. One reason is the labels and beliefs that each person carries regarding the pre-existing relationship and other person.

For this purpose, we ask all clients who have a pre-existing relationship with a Facilitator to intentionally and consciously set aside that existing relationship (including its dynamics, labels, attitudes, and beliefs) for the purposes of engaging in therapy.

If either a client or a Facilitator believe that this is not possible – and especially if the pre-existing relationship has ever been difficult or contentious – then it will be in the client’s best interest to engage with a different Facilitator, in particular for Phoenix Sessions.

As stated above, pre-existing or prior (within the past year) romantic or sexual relationships are disallowed between Facilitator and Client.

Additionally, a Facilitator will not provide services to those they have supervisory or evaluative authority over (eg students, employees), or in any other way possess the ability to influence external factors of the client’s life.

#9 A FACILITATOR WILL NOT MAKE FALSE OR MISLEADING STATEMENTS REGARDING THE UNIVERSAL SAFETY, EFFICACY OR GUARANTEED OUTCOMES OF PSILOCYBIN THERAPY

All statements made by Facilitators should be well-backed by scientific consensus including evidence (ie, clinical outcomes, published research) as a basis for making the statement or claim.

As exciting as psychedelic therapy is for the future of mental health care and psychiatry, it is not a panacea, and it does have contraindications for certain medical histories. These contraindications are covered in depth in our FAQ Page, Safety article. They are also screened for in the New Client Assessment.

Further, as much as we can predict how psilocybin will work in a client’s brain and discuss likely or desired outcomes, it is important that the client understand psychedelic medicine works broadly across the brain and body, and details surrounding how and where all it works are still being determined by researchers. Every individual is bio-unique and even each session is unique as individuals are constantly changing with regard to their mood, stress level, life events, nutrition, sleep quality, presence of other drugs, and myriad other factors.

Therefore, it is crucial for clients to understand that a certain outcome or result of any particular psychedelic therapy session is NOT guaranteed. The most beneficial approach is in thorough preparation, focused intention-setting, and an attitude of surrender and letting go of the illusion of control.

CLIENT CODE OF ETHICS:

So that we can keep psychedelic therapy safe, cost-effective and beneficial for the greater good and our communities, we ask the following from our Clients:

#1: Do not expect psychedelic therapy to fix every problem in your life. It is not a panacea.

#2: Do not expect psychedelic therapy to reach its full potential in your life with no effort on your part (or even self-sabotage, as can happen subconsciously or unconsciously).

#3: Realize that your Facilitator (and care team, the Fractal Staff) are human. They are trained and professional but they won’t always know everything, they have their own feelings and boundaries, and they are all students of life and healing themselves, despite how senior or well-practiced they are.

#4: Do not expect your Facilitator to direct your self-healing or psilocybin session. The entire approach toward both psychedelic therapy and trauma-informed therapy is CLIENT CENTERED, CLIENT LED. This means we will support and guide you but your journey is not about us – it is about YOU. You are Sovereign in your own care and healing. Yes, we can guide, mentor and support you, but the outcome of your health journey is entirely up to you and the work you put in. In particular, during any psychedelic therapy we make every attempt not to bring anyone else’s ‘energy’ in to your experience, as this can contaminate it. This includes your Facilitator.

#5: Just as the Facilitator will be vigilant to uphold your preference for touch, please be respectful of the Facilitator’s preference for touch as well. This will be discussed during your orientation.

#6: Be respectful within the Community. As a place who upholds the sanctity of safety for healing, we have a zero tolerance policy toward aggressive or abusive behavior, including physical or verbal. Members removed for violation of this principle will not be subject to a refund of any kind. We provide safe paths for the processing of anger, so please work with us to do that when you are feeling angry or frustrated or irritable.

#7: Protect others’ privacy. It is not your responsibility to inform others about our other Members. If you see someone you know in the Fractal Soul Community, please keep their identity and participation confidential in the outside world. If they wish to disclose their participation in our program, they will do so themselves and to whom they choose. We’re sure you’ll appreciate the same courtesy from them.
